Privacy and Cookies Policy

This privacy notice (“Privacy Notice”) describes how Telemetry LLC (“Telemetry,” “we” or “us”) collects, uses, discloses, and retains Personal Information that you provide to us or that we collect when you use our website (www.telemetryllc.com) and other websites owned or controlled by us (the “Sites”), use our mobile applications, use our business analytics and consulting services, or communicate with us.

1. Collection of Personal Information

As used herein, “Personal Information” generally means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you. Personal Information does not include information that is publicly available, de-identified, aggregated, or is otherwise exempted by applicable laws.  What Personal Information we collect may differ depending on how you interact with us.

We reserve the right to convert, or permit others to convert, your Personal Information into deidentified, anonymized, aggregated, or pseudonymized data, as permitted by law.

Personal Information we collect about you may include:

  • Contact information. This may include name, email address, phone number, billing and mailing address, zip code, etc.
  • Unique identifiers. This may include your signature, and history with us.
  • Customer records. This may include your consumer or business history with us.
  • Commercial information. This may include records of services or products purchased, obtained, considered, or other purchasing or consuming histories or tendencies.
  • Internet Analytics Information. This may include number of users, usage information, information regarding your interactions with our Sites, and related metrics.
  • Audio, electronic, visual, or similar information. This may include audio records of customer service calls.

2. Sources of Personal Information

We may collect Personal Information directly from you, from other parties, indirectly through cookies and other technologies, and from external sources, including the following sources.

A. Directly from You

We may collect Personal Information directly from you, when you:

  • Communicate or correspond with us by email, through postal mail, via phone or through other forms of communication we may collect the Personal Information you provide as part of those communications. 
  • Order services or products from us.

B. External Sources

We may receive your Personal Information from a variety of sources, including external parties such as contractors, data analytics providers,  and data brokers, as defined by applicable law. Any use of an external service may be subject to that service’s terms and privacy policies. 

We may also collect publicly available data or receive it from external sources that collect it on our behalf.  Publicly available information is generally not considered Personal Information.

C. Indirectly Through Cookies and Other Technologies

We may automatically collect Personal Information from you when you use our Sites via “cookies” and other similar technologies, such as web beacons.  Cookies are small amounts of data that are stored within your computer’s internet browser and are accessed and recorded by the websites you visit so they can recognize the same browser navigating online at a later time. Web beacons are transparent pixel images that are used in collecting information about website usage, email response and tracking.

Information that may be collected by cookies when you use our Sites may include, without limitation:

  • The pages you visit within our Sites;
  • The date and time of your visit to our Sites;
  • The amount of time you spend using our Sites;
  • The internet protocol (IP) address used to connect your computer to the internet; and/or
  • Your computer and connection information such as your browser type and version, operating system and platform.

This information is collected to enhance the Site performance and end user experience. You can set your browser to reject cookies or to notify you when you are sent a cookie. We may also work with external analytics services to help us understand how our Sites are being used, such as tracking the frequency and duration of use of our Sites. We may use Google Analytics, and web analytics services provided by Google (“Analytics Tools”) to collect information about your use of our Sites. These Analytics Tools may use cookies to collect information about the content you view, what websites you visit immediately prior to and after visiting our Sites, and your system information and geographic information. The information generated by these cookies about your use of our Sites will be transmitted to and stored by the applicable analytics services. The information collected by these analytics services allows us to analyze your use of our Sites. The Analytics Tools may also transfer this information to external parties where required to do so by law, or where such parties process the information on their behalf.

You may refuse the use of cookies by selecting the appropriate settings on your browser, however, please note that if you do this you may not be able to use the full functionality of our Sites.

By using our Sites, you consent to the processing of data about you by Google in the manner and for the purposes set out above. You may exercise choices regarding the use of cookies from Google Analytics by going to https://tools.google.com/dlpage/gaoptout. You can also opt-out of Google Analytics by installing Google’s opt-out browser add-on.

You can set your browser to refuse cookies from websites, but if you do so, you may not be able to access or use portions of our Services, and certain offerings on our Services may not function as intended or as well.

We are not responsible for opt-out processes provided by external parties.

3. Use, Disclosure, and Retention of Personal Information


A. How We Use Your Information

Telemetry uses Personal Information for the purposes described at the time of collection, to provide services to you, and address your inquiries. Telemetry also uses your information, as permitted by law, to provide you with information about Telemetry, our products and services or other products and services in which we believe you may be interested, including through advertising. We may also use your Personal Information to tailor your experience at our Sites, to compile and display content and information that we think you might be interested in, and to provide you with content according to these preferences. We may also use Personal Information to meet our legal obligations, work with law enforcement, for public safety purposes, in order to comply with laws, regulations, court orders, to assist in an investigation, to protect and defend our rights and property or the rights or safety of other parties, to enforce our rights or agreements with other parties, or for crime-prevention purposes.

B. How We Disclose Your Information with External Parties

Except as set forth in this Privacy Notice or when specifically agreed to by you, we will not disclose Personal Information we gather from you to external parties unless Telemetry is required to disclose it to complete your request or for business purposes. Telemetry discloses Personal Information in the following circumstances:

External Vendors.  We may disclose your Personal Information with vendors who deliver or provide goods and services or otherwise act on behalf of or at the direction of Telemetry.  These vendors may include, for example, our external technology partners. These vendors will only have access to the Personal Information needed to perform these limited functions on our behalf.

As Required by Law.  In addition to the other purposes for collection, use, and disclosure of Personal Information described in this Notice, we may collect, use, and disclose Personal Information as required by law, regulation or court order; to respond to governmental and/or law enforcement requests; to identify, contact or bring legal action against someone who may be causing injury to or interfering with our (or others’) rights or property; to support any actual or threatened claim, defense or declaration in a case or before any jurisdictional and/or administrative authority, arbitration or mediation panel; or in connection with disciplinary actions/investigations. Likewise, we may use and disclose Personal Information to third parties in connection with the sale, assignment, merger, reorganization, or other transfer of any of our brands or companies.

Aggregate Information. We may share your information with affiliated or unaffiliated external parties on an anonymous, aggregate basis.

C. Security of Your Information

Telemetry uses reasonable physical, technical and administrative measures to safeguard Personal Information you provide through the Sites or in connection with Telemetry’s services.  Please be aware that no data transmission over the Internet can be guaranteed to be 100% secure. As a result, Telemetry cannot guarantee or warrant the security of any information you transmit on or through the Sites and you do so at your own risk. 

Where we share your personal data with external parties, Telemetry takes steps to ensure that they use appropriate safeguards to protect your personal data.

D. Data Retention

Except as otherwise permitted or required by applicable law or regulation, we will only retain your Personal Information (which includes the categories of Personal Information set forth in the charts and sections above) for as long as necessary to fulfill the purposes we collected it for, as required to satisfy any legal, obligations, or as necessary to resolve disputes. To determine the appropriate retention period for Personal Information, we consider applicable legal requirements, the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes we process your Personal Information for, and whether we can achieve those purposes through other means. For certain types of Personal Information we will only maintain it for a limited duration.

4. Children

The Telemetry website is not directed to children under the age of thirteen (13) and Telemetry does not knowingly collect personally identifiable data from persons under the age of thirteen (13). If you are a parent of a child under thirteen (13) and you believe that your child has provided us with information about him or herself, please contact us at hello@telemetryllc.com.

5. Do Not Track

Your browser may allow you to adjust your browser settings so that “do not track” requests are sent to the websites that you visit. Telemetry does not respond to “Do Not Track” (DNT) signals.

6. Modifications to this Privacy Notice

From time to time, Telemetry may need to update or modify this Privacy Notice to reflect changes in our business practices, data collection practices, or organization. We reserve the right to amend this Privacy Notice at any time, for any reason, without notice to you, other than the posting of the amended Privacy Notice on the website. You should discontinue your use of our Sites, and cease providing Personal Information to us, prior to the time the modified Privacy Notice takes effect. If you continue using the Sites or provide Personal Information after the modified Privacy Notice takes effect, you will be bound by the modified Privacy Notice.
